Eric S. Olney Associate
Mr. Olney is an experienced litigator who focuses on complex commercial litigation and appellate advocacy. Mr. Olney has defended Fortune 500 companies, their officers, directors, and underwriters in various nationwide class actions involving federal and state securities laws. Mr. Olney also has substantial experience in M&A litigation and counseling parties to mergers and acquisitions. In addition, Mr. Olney has represented clients in disputes involving complex derivatives, reinsurance and other commercial matters.
Prior to joining Macht, Shapiro, Arato & Isserles LLP in June 2010, Mr. Olney worked at Cravath, Swaine & Moore LLP and Latham & Watkins LLP. Mr. Olney clerked for the Hon. William H. Pauley III of the United States District Court for the Southern District of New York.
Representative Matters:
- Lead associate in representation of Fannie Mae in consolidated securities fraud proceedings in the Southern District of New York. Obtained dismissal of claims under the Securities Act of 1933 brought against the company and numerous underwriters. Also successfully opposed an individual plaintiff's motion to remand, on the ground that SLUSA requires class action claims under the Securities Act to be litigated in federal court, an issue on which there is a case law split.
- Lead associate defending UBS against shareholder suits alleging that the bank tortiously interfered with a merger agreement. Obtained dismissal of all claims and won appeal of dismissal before the Second Circuit.
- Represented UBS in disputes arising from a failed multi-billion dollar merger, resulting in a favorable settlement. Served as lead associate managing trial teams in the Southern District of New York and Tennessee Chancery Court.
